1. Agreement to terms

These Terms & Conditions govern your access to and use of the Evalu8 platform, operated by TaskFlow Solutions (Pty) Ltd ("we", "us", "our"). By registering for an account, accessing, or using Evalu8, you agree to be bound by these terms. If you do not agree, you must not use the platform.

2. Service description

Evalu8 is a monthly staff performance review and evaluation platform. Features include team configuration, review scheduling, score tracking, reporting, and related tools. We may update or modify features from time to time without prior notice.

3. Accounts and eligibility

You must be at least 18 years old and authorised to act on behalf of your organisation to create an account. You are responsible for maintaining the confidentiality of your login credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorised access or use.

4. Subscriptions and billing

Evalu8 is offered on a subscription basis. Pricing is based on the number of employees selected for the service, as displayed on our pricing page. Subscriptions are billed monthly in advance through our payment processor, Payfast.

• By subscribing, you authorise us to charge your selected payment method via Payfast on a recurring monthly basis.
• All fees are quoted in South African Rand (ZAR) and exclude VAT unless otherwise stated.
• No refunds: subscription fees are non-refundable. If you cancel, you retain access until the end of your current paid period.
• You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• We reserve the right to adjust pricing upon renewal, with reasonable notice provided.

Payment processing is managed by Payfast. By using our payment services, you also agree to Payfast's terms and conditions. We are not responsible for Payfast's service availability or errors.

5. Acceptable use

You agree not to:

• Use Evalu8 for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorised access to the platform or its systems.
• Interfere with or disrupt the integrity or performance of the service.
• Upload malicious code, viruses, or harmful content.
• Reverse engineer, decompile, or disassemble any part of the platform.
• Share login credentials or allow unauthorised third-party access.

6. Data and content

You retain ownership of all data you input into Evalu8, including employee information and review records. You grant us a limited licence to use, store, and process this data solely to provide and improve our services.

You are responsible for ensuring you have the necessary rights and consents to upload employee data into the platform, in compliance with applicable data protection laws.

7. Intellectual property

All rights, title, and interest in Evalu8, including software, designs, logos, trademarks, and content provided by us, remain our property or that of our licensors. You are granted a limited, non-exclusive, non-transferable licence to use the platform during your active subscription.

8. Disclaimer of warranties

Evalu8 is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the service will be uninterrupted, error-free, or secure. Your use of the platform is at your own risk.

9. Limitation of liability

To the maximum extent permitted by law, TaskFlow Solutions (Pty) Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of Evalu8. Our total liability shall not exceed the amount you paid us in the twelve months preceding the claim.

10. Termination

We may suspend or terminate your account and access to Evalu8 at any time if you breach these terms or engage in fraudulent or harmful activity. You may cancel your subscription at any time through your account settings or by contacting support. Upon termination, your data will be handled in accordance with our Privacy Policy.

11. Governing law

These terms are governed by the laws of the Republic of South Africa. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

12. Changes to terms

We may modify these terms at any time. Material changes will be notified via email or through the platform. Continued use of Evalu8 after changes constitutes acceptance of the updated terms.
